These Terms & Conditions (“Terms”) govern your access to and use of the websites, booking tools, communications, and related services provided by Hendricks Venue (“Company,” “we,” “us,” or “our”). By accessing or using our services (collectively, the “Services”), you agree to these Terms.
We may update these Terms at any time. The “Last Updated” date reflects the most recent changes. Continued use of the Services after changes means you accept the revised Terms.
Event reservations, quotes, deposits, and balances may be governed by additional written agreements specific to your event (each, an “Event Agreement”). In case of conflict between an Event Agreement and these Terms, the Event Agreement controls.
Deposits may be required to hold dates. Unpaid balances may result in cancellation. Fees, taxes, and incidental charges may apply.
Cancellation, rescheduling, and refund terms will be stated at booking or in your Event Agreement.
You are responsible for your guests, vendors, and any damage to the venue or property during your event.
You agree not to misuse the Services. Prohibited conduct includes, without limitation:
All content on the Services—including text, graphics, logos, photos, and software—is owned by or licensed to us and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, or distribute our content without prior written consent.
By submitting content (e.g., reviews, photos), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the Services and our business. You represent you have the rights to grant this license and that your content complies with these Terms.
Our Services may link to third-party sites or tools. We do not control and are not responsible for third-party content, policies, or practices.
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, in no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising out of or related to your use of the Services. Our aggregate liability shall not exceed the greater of (a) amounts you paid us in the 12 months prior to the claim, or (b) USD $100.
You agree to defend, indemnify, and hold harmless Hendricks Venue and our owners, employees, and agents from any claims, damages, liabilities, costs, and expenses arising out of or related to your use of the Services or violation of these Terms.
Your use of the Services is also governed by our Privacy Policy.
By providing a phone number or email, you consent to receive service and promotional communications (including SMS/MMS) from us. Message/data rates may apply. You may opt out at any time by following provided instructions.
We may suspend or terminate access to the Services at any time for any reason, including suspected violations of these Terms.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Courts located in Palm Beach County, Florida shall have exclusive jurisdiction, except that we may seek injunctive relief in any court of competent jurisdiction.
